NOTICE OF SPECIAL MEETING

A SPECIAL CALLED MEETING OF THE MAYOR AND CITY COUNCIL OF THE CITY OF ABILENE, TEXAS, WILL BE HELD ON WEDNESDAY, SEPTEMBER 5, 2001 AT 9:00 A.M. IN THE CITY COUNCIL CHAMBERS OF CITY HALL, 555 WALNUT, FOR THE PURPOSE OF CONSIDERING THE FOLLOWING ITEMS:

        AGENDA

1.         Call to Order.

2.                  Invocation (Councilman Beckham).

3.                  Public Hearing:

a. Consider on second and final reading: Ordinance approving Revised 2000-01 Budget and Proposed 2001-02 Budget.

b.            Consider on second and final reading: Ordinance setting FY 2001-02 Tax Levy.

4.         Other Business:

a.                  Pending & Contemplated Litigation, Executive Session (see Litigation Section notice); possible action

b.                  Appointment and Evaluation of Public Officials, Executive Session (see Personnel Section notice); possible action

c.                  Deliberation regarding real property, Executive Session (see Real Property Section notice); possible action.

If personnel or litigation issues arise as to the posted subject matter of this City Council Meeting, an executive session will be held.

(Litigation)

The City Council may consider pending and contemplated litigation sub­jects.  The following subjects may be discussed:

      City v. Christian Academy of Abilene  

      Castillo v. City

      Edwards v. Weber v. City

      City v. Davis/Landers

      City v. Bonilla

      City v. Collier

      Gonzales v. City

      Duke v. Housing Authority/City (8/23/01)

      Shelley Denys v. City of Abilene (8/23/01)

Litigation is, by its nature, an on-going process, and questions may arise as to trial tactics, which need to be explained to the City Council.  Upon occasion, the City Council may need information from the City Attorney as to the status of the pending or contemplated litigation subjects set out above.  After discussion of the pending and contemplated litigation subjects, in executive session, any final action, or vote taken, will be in public.

(Personnel)

City Council may consider appointment, employment, reassignment, duties, discipline, or dismissal of public officers or employees, City Manager, City Attorney, Municipal Court Judge, City Secretary, and City Board and Commission Members.  A complete list of City Boards and Commissions are on file in the City Secretary's Office.  After discussion of appointment and evaluation of Council Ap­pointees and Board and Commission members in executive session, any final action or vote taken will be in public.

(Real Property)

City Council may consider the purchase, exchange, lease, or value of real property in a closed meeting when deliberation in an open meeting would have a detrimental effect on the position of the governmental body in negotiations with a third person, pursuant to Texas Government Code 551.072.
